Energoinvest seeks Supreme Court review of gas transport tariff ruling in Republika Srpska

Energoinvest, a Sarajevo-based gas importer, plans to take a dispute over natural gas transportation charges to the Supreme Court of the Republic of Srpska. The company said it will challenge a ruling on how regulated network tariffs are applied, arguing the case could influence the broader use of approved tariff rules. The filing is linked to transport fees that Energoinvest says should remain within the framework set by the competent regulator.

Energoinvest stated that network users should be billed according to the tariff framework approved by the regulator. It warned that applying different rates to network users could weaken legal certainty and undermine the regulatory system. The company’s position was followed by public statements from Sarajevo-Gas Istocno Sarajevo.

Second-instance decision and legal remedies

The move follows a second-instance judgment by the Higher Commercial Court of the Republic of Srpska. Energoinvest said it reviewed that ruling and intends to seek a revision within the statutory deadline. The company also said the second-instance decision did not exhaust all legal remedies available to it.

The dispute concerns whether transportation fees are being applied consistently across companies using the gas network. Energoinvest’s challenge is therefore tied not only to immediate charges, but also to how approved tariffs are implemented in practice. The case is expected to proceed through Supreme Court proceedings in Republika Srpska.

Potential wider impact on tariff application

Energoinvest said the Supreme Court process could have consequences beyond the specific financial claims of the two companies involved. It pointed to how a decision clarifying approved tariff application would affect predictability of gas transport costs. Such an outcome could also influence contractual relations across Bosnia’s fragmented gas market.
